China Adjusts Drone Export Controls: What Foreign Founders Need to Know

A practical overview of Announcement No. 49 of 2026 on optimized export control measures for unmanned aircraft items, and what foreign founders operating in China should watch for.

China Updates Drone Export Control List

The Ministry of Commerce, the General Administration of Customs, and the Equipment Development Department of the Central Military Commission issued Announcement No. 49 of 2026, publishing a decision to optimize and adjust export control measures for certain unmanned aircraft-related items. The announcement was approved by the State Council and the Central Military Commission and is grounded in the Export Control Law, the Foreign Trade Law, the Customs Law, and the Regulations on Export Control of Dual-Use Items.

For foreign founders whose China-registered companies manufacture, trade, or ship drone-related products, the announcement is a reminder that export compliance is a licensing question, not a paperwork formality. The following summary reflects only what the source document states.

Items Now Subject to Licensing

Under the announcement, the listed items may not be exported without a license. The scope covers several categories of unmanned aircraft systems and components.

Autopilots and Aircraft Performance Thresholds

Item 7A103.b covers autopilots specially designed for unmanned aircraft, with a reference customs commodity code of 90142010.10. Item 9A012.a addresses unmanned aircraft or unmanned airships capable of controlled flight beyond the operator's natural line of sight and meeting any of the listed characteristics.

One threshold described is a maximum endurance of at least 30 minutes but less than 3 hours, combined with the ability to take off and fly in a stable, controlled manner in gust conditions of 46.3 km/h (25 knots) or above. The announcement also defines key terms: an operator is a professional responsible for controlling the aircraft or airship through a ground control station, by remote control or programming; endurance is flight time converted to International Standard Atmosphere conditions (ISO 2533:1975) at sea level with zero wind; and natural line of sight is the maximum distance at which an observer on the Earth's surface can clearly see an object under ideal conditions without human interference or atmospheric pollution, with atmospheric effects normally considered in practice.

Engines and Propulsion

The announcement lists engines, including air-breathing piston or rotary internal combustion engines specially designed for flight above 15,420 m (50,000 feet), with reference codes 84071010.10 and 84071020.10. It also covers aero engines with maximum continuous power exceeding 16 kW under a set of reference codes, and turbojet engines with thrust of 400 N or more.

Radio Communication Equipment

Item 9A012.e covers radio communication equipment specially designed for the unmanned aircraft or airships controlled under 9A012.a and meeting any listed characteristic. The announcement defines equivalent isotropically radiated power (EIRP) as the radiated power in a given direction that an actual transmitting system would require from an ideal isotropic antenna to produce the same power density.

Motors, Controllers, and Blades

Item 9A112 addresses unmanned aircraft not controlled under 9A012, covering brushless motors specially designed for propellers and meeting all listed characteristics, electronic speed controllers specially designed to pair with items controlled under 9A901.a and meeting all listed characteristics, and blades made of carbon fiber composite material with any listed characteristic. The explanatory note states that variable-pitch functionality under 9A901.c.3 means structures such as a pitch-change pin on the blade root face or holes at the blade root for connecting a pitch-change rocker arm.

Technology

Item 9E902 covers technology for the development, production, or use of items controlled under 9A012.b, 9A012.c, 9A012.d, 9A012.e, and 9A901.

Licensing and Customs Declaration Duties

Export operators must apply to the competent department of the State Council for commerce for a license in accordance with the Export Control Law and the dual-use regulations. Exporters are also responsible for the truthfulness of declared goods. Where a product falls within the announcement, the exporter must declare its characteristics and indicators to customs and note "subject to export control" in the remarks column of the customs declaration form. Where a product is not listed but its characteristics are close to the thresholds, or where its use is outside the listed situations but other characteristics match, the exporter must still declare the relevant information and note "not subject to export control" in the remarks column. Customs may raise questions where it doubts the truthfulness of the information, and goods will not be released during that period.

Facilitated Procedures

The announcement sets out several procedural options. For exports of items controlled under 9A012.a.1, exporters may obtain an export voucher by registering and reporting information before each export, then export independently. For items controlled under 9A012.a and 9A112 used at exhibitions held inside China (excluding defense and police exhibitions), and returned in their original condition immediately after the event, or at exhibitions held outside China (excluding defense and police exhibitions) and returned to China in their original condition immediately after the event, exporters may similarly register before each export. Exporters that have established a well-functioning internal compliance system for dual-use export controls, with relevant export records and relatively stable export channels and end users, may apply for general licenses and other facilitation measures in accordance with the law.

What This Means for Founders

Foreign founders should treat the announcement as a prompt to review product classifications, customs codes, and end-use documentation before shipping. The definitions matter: endurance, line of sight, and power thresholds can determine whether a product needs a license. Maintaining an internal compliance system is also presented in the announcement as a route to smoother licensing treatment.
